Legal Notice for Cancellation of Power of Attorney in Dubai

Why the agent must be told

Under Federal Decree-Law No. 25 of 2025 (the Civil Transactions Law, in force from 1 June 2026), you can revoke or restrict your agent’s authority at any time (Article 898). But revocation on paper is not the end of the risk.

Article 144 of the same law says that where both the agent and the person they deal with “are unaware, at the time of concluding the contract, of the termination of the representation”, the contract still binds the principal. In plain words: if your former agent sells, signs or withdraws before they or the other side know the power of attorney has been cancelled, you may still be bound by what was done.

A served, dated notice is how you show the agent and those people did know. For an agent authorised for litigation, Article 902 is even clearer: if they act “after acquiring knowledge of their dismissal, they shall be liable”, and if they act before they know, the act is effective.

When you need a cancellation notice

• You have signed a revocation of a general or special power of attorney and the agent still has the original.
• The agent has authority over a bank account, a vehicle, a property, a company or a court case.
• You no longer trust the agent, or the task has changed.
• The agent is outside the UAE or not answering calls, and you need proof you tried to reach them.
• A bank, developer, company or court has a copy on file and must stop accepting it.

If the power of attorney ended on its own, for example because the task is complete or the agent has died (Article 897), a revocation is not needed, but telling the people who hold a copy is still sensible.

Before you send it: two legal points

Some powers of attorney cannot be cancelled alone. Article 898 says that where the agency “involves a right of a third party or was issued in the interest of the agent”, the principal may not end it without the consent of the person it protects. Check the wording of your document first, and get legal advice if it was given as part of a sale or a loan.

Timing can cost money. Under Article 899, a principal must compensate the agent for damage caused by revoking “at an inappropriate time, or without an acceptable justification”. A short, factual notice with a clear date helps show the cancellation was handled properly.

What the notice should say

• Your full name and Emirates ID or passport number, as principal.
• The agent’s full name and ID number, as in the power of attorney.
• The power of attorney being cancelled: date, notary reference or number, and what it covered.
• A clear statement that the power of attorney is revoked from a stated date, with the revocation deed reference.
• A demand that the agent stops acting under it and returns the original and any certified copies.
• A request that the agent accounts for anything done under the power of attorney, if relevant.
• Your date and signature.

A separate short letter, attaching the notice, goes to each bank, authority or company that holds a copy.

Step by step

1. Sign the revocation. The power of attorney is revoked by a notarised revocation deed, or for property through the Dubai Land Department’s free cancellation service. Our cancel power of attorney guide covers this step.
2. Send us the documents. The power of attorney, the revocation, your ID and the agent’s details.
3. We draft the notice in Arabic and English, matched to the power of attorney word for word.
4. Notarisation. You sign the notice before a notary public, who checks your identity and attests it. This can be done at our Business Bay office, online, or at your home.
5. Service on the agent. We serve the notarised notice on the agent at the address in the power of attorney or their current address, with a record of delivery.
6. Copies to the people who rely on it. We send the notice and the revocation to banks, the Land Department, RTA, companies or courts that hold a copy.
7. Proof kept. We keep the notarised notice, delivery records and cover letters together, so you can produce them if a dispute arises.

How the notice is served

The Civil Transactions Law does not name one method for telling the agent. What matters is that you can prove the agent received it and when. A notice notarised by a notary public and delivered with a record of receipt gives you that proof. We also send a copy by email and to the agent’s mobile where we have them, so the agent cannot say they never saw it.

If the agent is abroad, the notice can be sent to their foreign address. Where papers need to be used in another country, we can also help with documents attestation.

Common mistakes

• Revoking but not telling the agent. The agent may keep using the original, and a contract they make with someone who does not know of the cancellation can still bind you.
• Forgetting the bank or the Land Department. Each body that holds a copy must be told separately.
• Wrong document details. The notice must match the power of attorney exactly, or the recipient may say it refers to a different document.
• Relying on an old law. Many online templates quote an article from the repealed Civil Transactions Law. The current law is Federal Decree-Law No. 25 of 2025.
• No proof of delivery. Keep the notarised notice and the delivery record together.
